Q.What should a Will contain?

A.In brief, a Will should contain at least the following:

  • The identity (full name, address, city and state) of the Testator (the person whose Will it is).


  • A list of the beneficiaries (full names, address, and social security number is possible) and the inheritance each is to receive and alternates in the event they pass away before you.


  • The full name and address of the person you want to administer your estate (the "Executor") and an alternate Executor in the event your first choice is unable or unwilling to act as the Executor.


  • A clause alleviating the Executor from having to provide security – posting a bond -- for the value of the assets in the estate.


  • If you have minor children, a clause nominating someone to act as a guardian to your children, and someone else in the event your first choice is unable or unwilling to act as a Guardian.


  • If you have minor children, the age you wish your minor children to gain control over their inheritance.


  • Any burial requests you may have (cremation, burial, where you want to be buried or have your ashes spread.


  • Your signature.


  • Two Witnesses Signature and a Notarization.
