Q.What makes a Will valid?

A.The rules vary from state to state, but in general all Wills must be:

  1. signed by its author and witnesses, all of which must be of "sound mind." To be of sound mind, the person signing the Will and the witnesses witnessing the signature must not be mentally ill or disabled, not under duress, and not unduly influenced by beneficiaries listed in the Will.


  2. witnessed by at least two people (three in some states). The witnesses must actually watch you sign your name on the Will and then sign the Will themselves as witnesses. In some states, a witness to the execution of a Will may not be a beneficiary under the Will.


  3. uniform in its appearance. Either completely typewritten or handwritten. You should never use a fill-in-the-blank form Will.
