Q.Who will take care of my children if I die without a Will?
A.If you have children under the age of 18 and die without a Will nominating a Guardian for your underage children, your local state law determines who will look after your children. Typically, the law provides for the child's surviving parent to take custody, but if there is no surviving parent, there is a complicated set of rules the Court will apply to determine who is most appropriate for the surviving child. Creating a valid Will that nominates a Guardian, and an alternative Guardian "just in case" provides the best assurance that your minor children will be properly taken care of by the individual(s) you select.
