Q.Can’t I use an online or other paralegal service to create a living trust?
A.Although a revocable living trust is a relatively simple document, it actually can be a lot of work. First there needs to be a considerable amount of pre-planning. Your options should be thoroughly examined which typically will require a visit to an attorney. The estate plan decided upon can be simple, but it can also be complex. Even when a simple revocable living trust will suffice, once created it must be funded, or the trust will not exist in the eyes of the law.
Funding the trust can be tedious, time-consuming, and sometimes difficult. Funding a trust requires the title on all of the assets (real estate, bank accounts, vehicles, etc..) you want placed into the trust to be changed.
A notorious problem lawyers often see (often when it is too late) is a trust that was prepared online or by a paralegal service that was never funded. The individual who created the trust, simply failed to transfer any assets into the trust. If you create a revocable living trust and forget or improperly transfer your assets into the trust, it's basically useless.
