Q.What is Interstate Commerce and why is this important?

A.To register your mark at the federal level, you must show that the mark is either in-use, or have a good faith intent to use the mark, in interstate commerce. For goods, "Interstate commerce" involves offering the sale and selling the goods across state lines with the mark displayed on the goods and/or the packaging for the goods. For services, "interstate commerce" involves offering a service to those in another state, or rendering a service that affects interstate commerce (e.g. gas stations, hotels, restaurants, etc.).
