Q.How do I protect my trade secrets?
A.The actions necessary to establish and maintain confidential trade secret information is rather simple and inexpensive. In general, you must take whatever actions are reasonably necessary under the circumstances to prevent others from discovering the information. All employees and anyone else who may have access to the confidential trade secret information must be advised and should sign an appropriate confidentiality agreement. Adequate procedures should also be implemented to ensure the material is physically protected from prying eyes (encryption, password protection, etc..). Documents should be marked with legends which alert a reader to the nature of the document as "confidential" and "proprietary." However, if a third party independently discovers or develops the same information, you will lose your trade secret protection.
