Q.What is misappropriation of a trade secret?

A.Trade secret law protects against the misappropriation (wrongful taking) of trade secret information. A wrongful taking can occur if the taking constitutes a breach of contract, breach of a fiduciary duty, theft, or other legal wrong. If your trade secret is misappropriated, you may be able to recover control of the information and damages. Attorney fees and/or exemplary (e.g., punitive) damages can be recovered only in exceptional cases. Criminal penalties are available in cases of theft.
