Q.What can a Special Needs Trust pay for?

A.The Special Needs Trust should not be used for basic necessities such as food, clothing or shelter. To the contrary, the Special Needs Trust should provide for things not paid for by the government, such as specially designed equipment (van, motorized wheelchair), entertainment, recreation, movies, vacations, etc. With a Special Needs Trust, the trustee must be provided with the discretion to decide whether or not to pay for the special needs of the beneficiary; the payments cannot be mandatory.
