Q.What is the tenant blacklist?

A.. The tenant blacklist is a list of individuals who have been served with a summons and complaint for eviction and either lost or did not have their case dismissed within 60 days. If a landlord files for eviction and the tenant either ignores the summons and complaint or fights the eviction for over 60 days their name will be placed on the tenant blacklist forever. If the unlawful detainer case is dismissed or if the tenant wins their case within the 60-day period, then the case is "sealed" and the blacklisting companies cannot access your name without a court order.

There are actually companies that gather the names of all unlawful detainer defendants from public court records and place their names on the "blacklist." Unfortunately, once a name is on the blacklist, even if by mistake, it will remain there forever. If a prospective landlord, or if the landlord's property management company checks the blacklist, a blacklisted tenant will probably be denied.
