A.No, an attorney is not a legal requirement, but with non-lawyer formation services typically they will provide you with fill-in-the-blank forms (form Operating Agreement, form Organization Minutes, and form Membership Interest documents). When these basic forms are used many of the potential benefits afforded by the LLC can be lost. Moreover, you are left on your own as to subsequent record keeping. And worse yet, you have lost the single greatest benefit afforded by the LLC—the ability to customize the relationship of the members to best suit the member's needs.
