Q.Are there any types of judgments to which the homestead exemption will not apply?

A.Yes. The homestead exemption will not apply to:

  • Judgments obtained BEFORE the homestead declaration was filed and recorded;


  • Debts secured by the premises BEFORE the homestead declaration is recorded;


  • Debts secured by a mechanics' lien on the premises;


  • Voluntary encumbrances on the premises, such as mortgages or deeds of trust; and


  • Judgments for child support or spousal support.
