Q.Can a Court Invalidate My Living Will or Durable Power Of Attorney For Health Care?

A.Yes under certain circumstances. If your health care becomes the subject of a dispute and someone questions the validity of either your Living Will or Durable Power Of Attorney For Health Care, a court will review your health care directives to ensure they were properly executed (Signed, Witnessed, and Notarized) voluntarily and while you were of sound mind. A court may also revoke your named health care agent's authority if someone believes that your health care agent is not acting in your best interest, or according to your stated wishes
