Q.What is a Durable Power of Attorney for Health Care?

A.A durable power of attorney for health care is a legal document used to appoint a trustworthy individual adult (agent, proxy, attorney-in-fact) to make health care decisions for you when you are temporarily unable to communicate your wishes. Although a durable power of attorney for heath care usually gives your agent (proxy, attorney-in-fact) the power to make decisions regarding life prolonging treatments if your are terminally ill, if you have executed (signed) a valid Living Will the Living Will will take precedent over the Durable Power of Attorney if and when you become terminally ill.
