Q.Can the escrow officer solve disputes between the parties?
A.California law prohibits an escrow officer from favoring any of the parties involved in the escrow. An escrow officer's power is strictly limited to following the agreed upon escrow instructions. The escrow officer does not have the power or authority to referee disputes between the parties. If the buyer, seller and/or lender have a dispute, the escrow officer can do absolutely nothing until the parties involved in the escrow settle the dispute amongst themselves, or with the assistance of their attorneys.
