Q.Can my employer take a percentage of my tips?

A.No. Labor Code Section 351 prohibits an employer from collecting, taking or receiving, in whole or in part, a tip or gratuity left by a patron of its business for an employee. However, the owner of a restaurant may require all employees to pool or share their tips with the other servers, bartenders, and bus boys providing table service.
