Q.When is a computer professional entitled to overtime?

A.Effective January 1, 2008, a large portion of California's computer programmers will no longer be entitled to overtime. The new law reduces the minimum hourly rate of pay for computer professionals from $49.77 to $36.00 per hour. In turn, computer professional earning $36 per hour or more are no longer entitled to overtime if the computer profession is primarily engaged in one or more of the following duties:

  1. systems analysis techniques and/or procedures (including consulting with users) to determine hardware, software or system functional specifications;


  2. computer hardware design, development, documentation, analysis, creation, testing or modification (including prototypes); or


  3. computer software design, documentation, testing, creation or modification.
