Q.Can the employer give a nonexempt employee time-off in lieu of paying overtime?

A.No. For profit businesses and employers may not give their employees time-off in lieu of paying overtime. However, state and local governments may in some circumstances give their employees time off at the rate of one and one-half hours for each hour of overtime worked.
