Q.If an employee works unauthorized overtime is the employer obligated to pay for it?
A.Yes. California employers must pay overtime, whether authorized or not at the rate of one and one-half (1.5) times the employee's regular hourly rate for all hours worked in excess of 8 in a day and for the first 8 hours of work on the seventh consecutive day of work in a work week. Employees are entitled to double time (2.0 times the employee's rate of pay) for all hours worked in excess of 12 hours in any day and for all hours worked in excess of 8 on the seventh consecutive day of work in a work week.
If an employee works unauthorized overtime, the employer is limited to disciplining or terminating the employee.
