Q.If I am required to live at my place of employment (e.g. resident manager of an apartment building) can my employer pay me the minimum wage less the cost of my apartment?
A.Yes, so long as your employer does not deduct the full rental value of your apartment as a credit toward your receipt of the minimum wage. If, as a condition of employment, the employee must live at the place of employment, then the employer can credit the following housing and/or food amounts towards the employee's receipt of the minimum wage:

To qualify for the “credit” of housing and/or food against the minimum wage, the employer must have a voluntary written agreement with each employee who receives this substitution and the credit cannot exceed the amounts set forth in the above table.
