Q.Can an outside salesperson agree to work for less than minimum wage?

A.Yes. Outside salespersons are exempt from all California Industrial Wage Orders, including the state's minimum wage and California's Labor Code Section 1171.

Inside Salespersons, however, must be paid at least the minimum wage and they are only exempt from overtime if they earn at least 1.5 times the minimum wage and if more than half of their compensation represents commissions.
