Q.How does vacation time affect an employer's termination policies? (CA)
A.In California, employers are not required to offer their employees paid vacation time. However, when they do it is considered part of the employee's wages. As such, at the time of termination, or resignation, the employer must pay the employee any unused paid vacation time. Vacation time is said to "vest" at the time labor is performed on a daily basis, and must be paid to the employee on a pro-rated basis when the employment is terminated.
