Q.How do I dispute a credit card purchase?

A.Credit card purchases are protected under the Fair Credit Billing Act. This law gives the consumer the right to withhold payment on poor-quality or damaged merchandise purchased with a credit card. To avail yourself of the protections offered by the Fair Credit Billing Act, the card holder must make a real effort to resolve the dispute with the merchant before asking the credit card company to stop payment.

The credit card holder should contact the merchant by phone first to see if the matter can be resolved. If the matter goes unresolved, the credit card holder should put his or her complaint in writing and send it to the merchant with a copy to the credit card company via certified mail return receipt requested.

The card holder must contact the credit card company in writing within 60 days, so do not procrastinate.

It should also be noted that technically for the Fair Credit Billing Act to apply, the sale must exceed $50 and have taken place in your own state or within 100 miles of your home address. Fortunately, most credit card companies do not enforce these two pre-conditions.
