Q.How long do directors serve on the board of directors?

A.To answer the question requires an examination of the homeowners association's Articles and Bylaws. The homeowners association's bylaws should contain a section that articulates the minimum number of directors, their term (length of service), and any qualifications required. It is not necessary for all directors to have the same length term, or for all of the directors’ terms to expire in the same year. If fact, most bylaws provide for staggered terms to preserve the stability of the Board. If all of the director seats came up for re-election at the same time, a complete turnover could cause instability- everything the previous board knew and tried gets lost in the transition.

Under California law, a director's term cannot exceed four years, and if the bylaws do not specify the term length, California law provides that the term shall be one year.
