Q.How are the CC&R's enforced?

A.Pursuant to California law either the homeowners association ("HOA"), or an individual homeowner, can file a lawsuit asking the court to enforce the Declaration of Covenants, Conditions, and Restrictions ("CC&Rs"). The law currently requires, with some exceptions, either the homeowner or the HOA offer to engage in some form of alternative dispute resolution process before filing a lawsuit. You should consult with a local real estate attorney if you are contemplating an enforcement matter.
