Q.How should my lease define my business if I want “exclusivity”?
A.You want to specifically define the nature of your business, but in general terms. The business community standard will be applied to the terms your select. For example, if you own a sporting goods store, you may want to state retail sporting goods, including but not limited to biking, skiing, golfing, basketball, football, soccer, aerobic, tennis, and camping equipment. If the landlord later attempts to rent adjacent premises to an individual in a similar business, be sure to immediately send the landlord a written objection. This will preserve your right to bring legal action for injunctive relief and/or damages.
