Q.Do individuals with mostly business debts have to attend Credit Counseling Before Filing For Bankruptcy?

A.Yes, almost all individuals, even those with primarily business debts, must obtain both pre- and post- bankruptcy credit and financial counseling from a government approved agency (U.S. Trustee Program) both before and after filing for Chapter 7, Chapter 13, and Chapter 11 bankruptcies. More information on the procedure for pre-bankruptcy filing credit counseling (and a list of government approved credit counseling agencies) is available from the U.S. Trustee Program, a division of the Department of Justice responsible for overseeing the administration of bankruptcy cases.
