Q.How often can you file Bankruptcy?

A.The answer depends on the type of bankruptcy previously filed and to be filed. Individuals can file a Chapter 7 bankruptcy 8 years after they have filed for a prior Chapter 7 bankruptcy. Individuals can file a Chapter 13 bankruptcy 6 years after they filed a prior Chapter 13 bankruptcy.

However, individuals may file a Chapter 13 bankruptcy 4 years after filing a previous Chapter 7 bankruptcy, or 2 years from a prior Chapter 13 filing.

Filing bankruptcy can adversely affect your ability to obtain future credit, rent housing and even negatively impact a job application, so any decision to file for bankruptcy should be carefully considered.
