Copyright Registration Errors
Oftentimes the Copyright Office will register a copyright even though it contains errors or mistakes. These errors often occur because the individual preparing the application was misinformed or misunderstood the form. Although the Copyright Office only permits a published work to be registered once, they do provide a means by which the copyright owner may correct an error later discovered.
Supplemental Copyright Registration - Form CA
If an error is discovered in a previously registered copyright, the Copyright Office will permit the copyright owner to file a supplemental registration (FORM CA) to correct the error or mistake. This should be done whenever there is an error in the original registration that may have been overlooked by the Copyright Office, or if present circumstances dictate the need to clarify information such as:
- identifying the wrong person as the author;
- failing to include all of the authors;
- incorrectly marking the registration as published or unpublished, when in fact is was the opposite;
- inaccurately stating the extent of the copyright (e.g. when you meant to exclude certain portions of the work as belonging to someone else or incorporating works already in the public domain);
- reflect a change of address (although not necessary it is recommended);
- reflect a name change; or
- reflect a change in the title of the previously registered work.
Copyright License or Copyright Assignment (Sale of your Copyright)
If you transfer, license, or sell your copyright, do not file a supplemental registration on FORM CA. This is known as a copyright assignment or license, which if properly drafted can be recorded with the Copyright Office. We suggest you consult a local attorney if you are plan to transfer, sell, or license your copyright, or if you are the intended transferee, licensee, or buyer.
